This photo has two violations. One, the childrens bounce house is not allowed. It is on common property which the Board is responsible for. Board permission is required. Also, do the residents have insurance if something happens to a child? The homeowners association insurance has sky rocketed to $81,000 a year. We do everything we can to keep it at that level.

Secondly, the blue tarp is hanging from the roof of the building. How is it attached? Again, it is a common area and permission from the Board is mandatory.

This and That
There are many changes that will take place July 1 2026 based on Indiana law. The Board of Directors have nothing to do with these actions. Some of these actions will increase the costs of the homeowners assocaition. Some will make it easier to make changes. Here is a brief run down of the changes;

1987 Legal Precedent: A case decided in 1987 established the precedent that many used to argue against the legality of fines in Indiana, leading to the assumption for years that fines were not allowed.
|
Starting July 1st 2026, according to HB1115; One of the most significant improvements in the new legislation is the statewide authority for associations to issue fines. Previously, Indiana associations could only issue fines if their governing documents explicitly allowed it. The new law allows all Indiana community associations to impose fines, even if the governing documents do not expressly authorize them.

The Wildwood Board willl be working on a list of violations and the fines associated with them.

Rentals - As of July 1st, the rules will change. This is two-fold. One, our documents says that to change them, we must get 75% (116) of the owners to agree. HB1210 now says that only 67% is required. Beginning on July 1, 2026, (HB1210) only owners who occupy their property as a homestead (primary residence) may vote on associations matters involving restrictions or prohibitions on rental properties. This means that the Board only needs about 65 owners approval to limit rentals. Existing rentals would have to be grandfathered until they are sold.

What Fannie Mae & Freddie Mac’s Latest Policy Changes Mean for Condominium Associations, Lenders, and Homeowners
What this means for Wildwood - Fannie Mae & Freddie Mac buy about 70 percent of mortgage loans from lenders, if they follow their rules. This is how lenders keep having money to lend. One of their requirements in the above article is for our reserve fund to be 15 percent of our overall budget, up from 10 percent. Currently, our reserve fund budget is about 11.39 percent. This year it would take $7.60 more a month in dues just to meet the 15 percent. Fortunately, this does not start until Jan. 4th, 2027.

Why is this important? Because if you are going to sell your condo, your buyer can't get a mortgage because our reserves are not 15 percent of our budget (Fannie Mae & Freddie Mac rules). Without sales, prices will continue to be the same or drop. Would you like to sell your condo for 80 percent of what you paid for it?

What's Going On in Wildwood...
- Officers report - Mostly quiet. Issues with parking and vehicle tagging are ongoing, one vehicle towed. Report of one recent theft of a package from front porch. Another report of a suspicious person in community. Officers will continue to follow up as needed.
- Because of lack of funds, no reserve fund deposits had been made this year. This was remedied by 4 payments to the reserve account.
- The Board was concerned about the mowers large tires rip the turf. Julie was going to notify the mowing company if anything could be done.
- The Board discussed the recent laws that are going to be passed on July 1st this year. Because of the law, our documents could be updated easier. We would only need less than 65 owners approval.
- The Board discussed the onging issue with residents not cleaning up after dogs in the community. A Board member will purchase signs for problematic areas on Wildwood Court.
- The Board discussed scratches on the clubhouse floor. Our floor representitive will be contacted and see if there is anything we can do.
- The Treasurer will periodically review settled accounts with a credit baoance and send a list to attempt to refund to former owners.
- Next Board Meeting will be May 20th, 6:30 PM in the Wildwood Clubhouse.
